Introduction
Welcome to Haifa Bin Saedan Real Estate Valuation ("the Company," "we," "us," or "HBS"). These Terms of Service ("Terms") explain the rules and conditions governing your use of our website https://www.hbs-realestate.com and the real estate valuation services we provide.
By accessing our website, using our services, or requesting a real estate valuation report, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

1. Definitions
For the purposes of these Terms, the following terms mean:
"Company," "we," "us," or "HBS": Haifa Bin Saedan Real Estate Valuation, a company registered in the Kingdom of Saudi Arabia and licensed by the Saudi Authority for Accredited Valuers (TAQEEM).
"Client," "you," or "your": Any individual or legal entity using our website or requesting real estate valuation services from the Company.
"Website": The Company's website available at https://www.hbs-realestate.com and all associated pages and content.
"Services": All real estate valuation services provided by the Company, including but not limited to: residential valuation, commercial valuation, industrial valuation, land valuation, hotel valuation, warehouse valuation, real estate consulting, and any other related services.
"Valuation Report": The final document issued by the Company containing the valuation of the property's value based on accredited professional standards.
"Property": Any real estate (land, building, residential unit, commercial facility, etc.) for which valuation is requested from the Company.
"Third Party": Any person or entity other than the Company or the Client, such as banks, insurance companies, courts, or any other party that may rely on the valuation report.
2. Scope of Services
2.1 Services Provided
HBS offers a comprehensive range of accredited real estate valuation services, including:
Residential Valuation: Valuation of villas, apartments, houses, residential land, and other residential units for purposes of sale, purchase, financing, insurance, or accounting.
Commercial Valuation: Valuation of offices, retail shops, shopping malls, administrative buildings, and other commercial properties.
Industrial Valuation: Valuation of factories, warehouses, industrial facilities, and industrial land.
Land Valuation: Valuation of vacant land (residential, commercial, industrial, agricultural) based on location, permitted use, and market factors.
Hotel and Hospitality Valuation: Valuation of hotels, resorts, serviced apartments, and tourism facilities.
Real Estate Consulting: Providing specialized consulting on the real estate market, feasibility studies, real estate investment analysis, and real estate asset management.
Additional Services:
- Valuation of properties for legal purposes (litigation, partition, inheritance)
- Valuation of distressed properties or properties for judicial sale
- Valuation of real rights (usufruct, easement)
- Review of valuation reports issued by other parties
2.2 Professional Standards
All valuation services we provide comply with:
- International Valuation Standards (IVS) issued by the International Valuation Standards Council
- Valuation standards issued by the Royal Institution of Chartered Surveyors (RICS)
- Saudi Valuation Standards issued by the Saudi Authority for Accredited Valuers (TAQEEM)
- Saudi regulations and laws related to real estate valuation
2.3 Valuer Independence
We are committed to complete independence and neutrality in all valuation work. We will not accept any assignment that may lead to a conflict of interest, and we will not be influenced by any external pressures that may affect the objectivity of the valuation.
3. Service Request Process
3.1 Submitting a Request
You can request valuation services through:

3.2 Required Information
When submitting a request, you must provide the following information:
- Complete contact information (name, email, phone number)
- Property details (type, location, size, condition)
- Purpose of valuation (sale, purchase, financing, insurance, legal, etc.)
- Required documents (title deed, plans, photos)
- Any additional information that may be relevant
3.3 Request Review and Proposal
After receiving your request, we will:
- Review the request: Verify completeness of information and documents
- Assess feasibility: Ensure no conflict of interest and our ability to execute the task
- Prepare proposal: Send a detailed price quote including:
- Scope of work
- Fees and costs
- Expected timeline
- Payment terms
- Any special conditions
3.4 Proposal Acceptance
The contract is considered effective upon:
- Your written acceptance of the proposal (email, signature on contract)
- Payment of the down payment (if any)
Once you accept the proposal, you are bound by these Terms and any additional terms specified in the proposal or service contract.
4. Fees and Payment
4.1 Fee Structure
Valuation fees are determined based on several factors:
- Property type and complexity: Commercial and industrial properties typically require higher fees than residential
- Geographic location: Distant properties may require additional travel costs
- Purpose of valuation: Valuations for legal purposes may require additional work
- Timeline: Urgent requests may require additional fees
- Scope of work: Comprehensive valuations cost more than simplified valuations
4.2 Payment Terms
Down Payment: We may request a down payment (typically 50% of total fees) before starting work, especially for new clients or large projects.
Final Payment: The remaining amount must be paid upon delivery of the final valuation report or within the period specified in the invoice (typically 14 days from invoice date).
Accepted Payment Methods:
- Bank transfer
- Credit/debit cards (via secure payment gateways)
- Checks (for approved clients)
Invoices: We will issue an official tax invoice including Value Added Tax (15%) in accordance with the regulations of the Zakat, Tax and Customs Authority.
4.3 Late Payment
In case of late payment:
- We will send a reminder after 7 days from the due date
- We may charge a late fee of 2% monthly on overdue amounts
- We reserve the right to withhold delivery of the final report until full payment of dues
- We may take legal action to recover amounts due
4.4 Refunds
Before Starting Work: If you cancel the request before we start work, we will refund the down payment in full (minus any actual administrative costs).
After Starting Work: If you cancel the request after we have started work (such as site inspection, data collection), we will retain the down payment to cover costs incurred, and may claim additional fees based on the percentage of work completed.
Dissatisfaction with Service: If you are not satisfied with the quality of service, please contact us immediately. We will do our best to resolve the issue. We do not offer refunds after delivery of the final report except in cases of gross professional error.
5. Client Obligations
5.1 Providing Accurate Information
You are obligated to provide accurate, complete, and truthful information about the property. Any incorrect or misleading information may affect the accuracy of the valuation and may lead to cancellation of the assignment.
5.2 Providing Documents
You must provide all required documents in a timely manner, including:
- Title deed or proof of ownership
- Approved architectural plans
- Building permit and completion certificate (if any)
- Current lease agreements (for leased properties)
- Maintenance or technical inspection reports (if any)
- Any other documents we may request
5.3 Allowing Inspection
You must allow our valuers access to the property at the scheduled time to conduct the site inspection. If you cannot provide access, you must notify us at least 48 hours in advance to reschedule.
Not Allowing Inspection: If you do not allow inspection without acceptable excuse, we may have to:
- Issue a limited valuation report (Desktop Valuation) based on available information only
- Cancel the assignment and retain the down payment
- Charge rescheduling fees
5.4 Cooperation with Valuer
You must fully cooperate with the valuer, including:
- Answering questions honestly and accurately
- Providing any additional information the valuer may request
- Not attempting to influence or pressure the valuer to reach a specific value
Attempting to Influence Valuation: Any attempt to influence or pressure the valuer to modify the value is considered a serious violation of these Terms and may lead to immediate cancellation of the assignment without refund of fees.
5.5 Use of Report
You are obligated to use the valuation report only for the purpose specified in the assignment. Any other use requires our written consent.
Not Publishing the Report: You may not publish the valuation report or any part of it on social media, websites, or any public medium without our written consent.
6. Company Obligations
6.1 Professional Competence
We are committed to providing real estate valuation services to the highest standards of professional competence, through:
- Accredited and qualified valuers (TAQEEM, RICS)
- Application of international and local valuation standards
- Use of the latest tools and techniques in valuation
- Continuous updating of real estate market data
6.2 Confidentiality
We are committed to maintaining the confidentiality of all information you provide to us. We will not disclose any information to third parties except:
- With your written consent
- To the party that requested the valuation (such as the bank in case of financing)
- Based on a legal request from a competent authority (court, regulatory body)
6.3 Objectivity and Independence
We are committed to complete neutrality and independence in all valuation work. We will not accept any assignment that may lead to a conflict of interest, and we will not be influenced by any external pressures.
6.4 Timeline
We are committed to delivering the valuation report within the period specified in the proposal (typically 5-10 business days from the date of site inspection, depending on property complexity).
Delay: If we are delayed beyond the specified date for reasons beyond our control (such as client delay in providing documents, force majeure), we will notify you immediately and set a new date.
6.5 Report Quality
We are committed to issuing comprehensive and detailed valuation reports that include:
- Complete description of the property
- Real estate market analysis
- Valuation methodology used
- Assumptions and limitations
- Final market value
- Photographs and maps
- Valuer signature and accreditation
7. Limitation of Liability
7.1 Valuation Accuracy
We do our best to provide accurate and objective valuation. However, real estate valuation is a professional opinion and not an absolute fact. The actual value of the property may differ from the estimated value based on market factors, negotiations, and sale conditions.
We Do Not Guarantee:
- That the property will be sold or purchased at the estimated value
- That the value will remain constant over time
- That all parties will agree on the estimated value
7.2 Reliance on Information Provided
We rely on the information and documents you provide to us. We assume that all information is correct and accurate. We are not responsible for any errors in the valuation resulting from incorrect or misleading information you provided.
7.3 Limitations on Liability
Maximum Liability: In case of professional error on our part, our liability is limited to:
- Re-conducting the valuation free of charge, or
- Refunding fees paid
We Are Not Liable For:
- Indirect or consequential damages (such as loss of profits, lost investment opportunities)
- Damages resulting from use of the report for a purpose other than the specified purpose
- Damages resulting from third-party reliance on the report without our consent
- Damages resulting from market changes after the valuation date
7.4 Professional Insurance
We are insured with professional liability insurance covering errors and professional negligence. In case of direct damage resulting from gross professional error on our part, you can claim through the insurance company.
8. Intellectual Property
8.1 Copyright
The valuation report and all associated content (texts, tables, charts, images) are protected by HBS copyright.
8.2 Usage Rights
Upon full payment of fees, we grant you a limited and non-exclusive license to use the valuation report for the purpose specified in the assignment only.
What is Allowed:
- Use the report for the specified purpose (sale, purchase, financing, etc.)
- Share the report with concerned parties (bank, lawyer, insurance company) with our consent
- Keep a copy of the report for your personal records
What is Not Allowed:
- Publish the report or any part of it on the internet or social media
- Resell or lease the report
- Modify or edit the report content
- Use the report for other purposes than specified without our written consent
8.3 Trademarks
All trademarks, logos, and service names displayed on our website are the exclusive property of HBS or its licensors. They may not be used without our written consent.
9. Dispute Resolution
9.1 Amicable Negotiation
In case of any dispute or disagreement between us, we encourage you to contact us first to try to resolve the issue amicably. Please send your complaint in writing to disputes@haifa.com.
We will respond to your complaint within 7 business days and try to reach a satisfactory solution for both parties within 30 days.
9.2 Mediation
If we cannot resolve the dispute amicably, we agree to refer the dispute to mediation through an accredited mediation center in the Kingdom of Saudi Arabia. Mediation costs are split equally between the parties.
9.3 Arbitration
If mediation fails, the dispute is referred to arbitration in accordance with the Saudi Arbitration Law. The arbitrator's decision is final and binding on both parties.

- Place of arbitration: Riyadh, Kingdom of Saudi Arabia
- Language of arbitration: Arabic
- Applicable law: Saudi regulations
9.4 Jurisdiction
In case of not resorting to arbitration, the competent courts in the city of Riyadh, Kingdom of Saudi Arabia, have jurisdiction to consider any dispute arising from these Terms or use of our services.
10. Force Majeure
We are not liable for any delay or failure to perform our obligations due to circumstances beyond our reasonable control ("Force Majeure"), including but not limited to:
- Natural disasters (earthquakes, floods, storms)
- Wars, terrorist acts, civil unrest
- Epidemics and pandemics (such as COVID-19)
- Labor strikes
- Prolonged power or internet outages
- Changes in laws or government regulations
- Any other circumstance beyond our reasonable control
In case of force majeure, we will notify you immediately and do our best to minimize delay and resume service as soon as possible.
11. Termination
11.1 Termination by Client
You have the right to terminate the assignment at any time with written notice. However:
- If you terminate before starting work: We will refund the down payment (minus administrative costs)
- If you terminate after starting work: We will retain the down payment and claim additional fees based on work completed
11.2 Termination by Company
We have the right to terminate the assignment immediately without prior notice in the following cases:
- Non-payment of fees due
- Providing false or misleading information
- Attempting to influence or pressure the valuer
- Non-cooperation or not providing access to the property
- Discovery of conflict of interest
- Any material breach of these Terms
In case of termination on our part due to your fault, we will not refund any fees paid.
11.3 Effects of Termination
After termination of the assignment:
- All work stops immediately
- All fees due must be paid within 14 days
- We reserve the right to retain any work completed
- Confidentiality and intellectual property provisions remain in effect
12. General Provisions
12.1 Amendments to Terms
We reserve the right to amend these Terms at any time. We will notify you of any material amendments by:
- Posting the updated Terms on our website
- Sending a notice via email (for current clients)
Your continued use of our services after posting amendments means your acceptance of the updated Terms.
12.2 Governing Law
These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.
12.3 Severability
If any provision of these Terms is found to be illegal or unenforceable, that provision is considered severable and the remaining provisions remain in effect.
12.4 Waiver of Rights
Our failure to exercise any right under these Terms does not constitute a waiver of that right.
12.5 Non-Assignment
You may not assign your rights or obligations under these Terms to a third party without our written consent. We may assign our rights and obligations to a third party without your consent.
12.6 Entire Agreement
These Terms, together with any specific service contract or price quote, constitute the entire agreement between us and supersede all prior agreements or understandings (oral or written).
12.7 Language
These Terms are available in Arabic and English. In case of any conflict, the Arabic version prevails.
